I think anyone with half a brain cell knows the Kurtofsky kiss was not rape, nor was it sexual assault. I don’t think that is a point that can be argued with.

The kiss, when taken in the context of what preceded and followed, could however be taken as sexual harassment. I wouldn’t argue if someone labelled it that, and I think it’s a fair judgement. I think there are reasons to explain why Dave’s character took a turn for the creepy (read: Darren’s popularity and Chris asking for time to work on his film meaning less time for shooting Glee), but that is really neither here nor there. Canon is what canon is.

Now, in all this, Kurt never once expressed any desire or interest in pursuing things legally, and clearly thought he had a handle on things until Furt. At which point he chose to remove himself from the situation as the school process had failed to remove Dave. Again he doesn’t want to formalise anything legally, probably due in part to sympathising with Dave’s closeted struggle. Regardless of if it was sexual harassment the right to prosecute Dave always lay with Kurt, and he chose not to.

Kurt then returns when he feels Dave is no longer a threat, and Dave apologises to Kurt. I think when he said, “For what I did to you,” he doesn’t just mean the bullying, but also the kiss (in some respects) and the harassment that followed. You can deny all you want that Kurt didn’t ‘technically’ accept that apology, but the apology was made, and Kurt seemed keen to note that he no longer hated Dave, and knew he was sorry. Kurt in essence forgave Dave for his wrongdoings.

You may think Dave wasn’t punished enough.

You may think what Dave did was ‘rape’ or ‘sexual assault’.

What you think has no bearing on Kurt’s actions and he is obviously satisfied that Dave is sorry and that they can start to put that past behind them. Just because you can’t doesn’t mean you’re inherantly right, or that Kurtofsky is a crackship, or is in any way illigitimate. These are the same tired, refuted arguments that have been circulating since November, and frankly they have been done to death.

Think what you want, but please don’t voice your views in places that is likely to upset people that do ship them, okay? That includes tags and videos like the Kurtofsky kiss.

We’d all thank you for it.
